HauteGastronomyTours is not a travel agency and does not provide or own transportation services, accommodations, tours, excursions, or other travel experiences. Although HauteGastronomyTours displays information about travel experiences offered by third-party suppliers and facilitates reservations with those suppliers, you agree that HauteGastronomyTours is not responsible for the accuracy or completeness of the information it obtains from third-party suppliers and displays on its Website.
If you book a reservation for a travel experience through the Website, you agree to review and be bound by the supplier's terms and conditions and any other rules or policies related to the supplier's travel experience. Your interactions with third-party suppliers are at your own risk. HauteGastronomyTours will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches, or negligence of any third-party suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with third-party suppliers.
This Website may link you to supplier sites or other websites that HauteGastronomyTours does not operate or control.
**Modifying
or Amending Your Booking**
All requests for modifications and amendments to your booking must be directed to the HauteGastronomyTours Customer Service, who will process the request. See the section “Payment & Cancellations” below for additional information with respect to canceling a booking.
- HauteGastronomyTours does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by our Customer Care team more than three (3) days ahead of your confirmed travel date.
- It is not possible to change or modify a special event, theater, or show ticket. Sales of these tickets are final and cannot be amended once your original purchase is confirmed.
- All other date-change requests and amendments are subject to availability by our suppliers and/or service providers; HauteGastronomyTours cannot guarantee the success of any date-change request.
- If you request a date change within three (3) days or less of your confirmed travel date, HauteGastronomyTours will attempt to honor your request; however, changes made three days or less from your original travel date may be subject to an additional fee. For multi-day and overnight tours, date changes made within seven (7) days of your confirmed travel date may also be subject to additional fees.
- If you make a purchase using a HauteGastronomyTours promotion code, or if you accept a discount or special-offer price during the HauteGastronomyTours checkout process, you may invalidate your discount or special-offer price by making any changes or amendments to your itinerary once your purchase is complete. HauteGastronomyTours may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However, HauteGastronomyTours reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.
Occasionally our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, and other Product features and/or requirements. As a result, HauteGastronomyTours reserves the right to cancel, change or substitute any service, tour, ticket, or product that you have booked on this Website, at any time, for any reason. In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price. Notwithstanding the above, when we are informed in advance by our agents, service providers, and/or suppliers of a significant change to a booking and/or to a tour, product, or event, we make every reasonable effort to notify the consumer, travel agent, and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.
**Pricing & Inclusions/Exclusions**
Prices listed on the Website are per person unless otherwise specified.
Price quotations are subject to change without notice until a booking has been confirmed.
Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges, or international transportation tax.
Prices do not include tips/gratuities to tour directors, drivers, or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed under “Inclusions” on the product pages of the Website.
**Payments & Cancellations**
When you book a reservation for a Product through the Website, HauteGastronomyTours collects your payment information and processes your payment as described below under “Payment Processing.” HauteGastronomyTours accepts the following credit cards: Mastercard, Visa, and American Express. Full payment or Reservation Deposit by credit or debit card is required to make a reservation. Payment will be listed as HauteGastronomyTours on the credit or debit card statement.
No refunds are available once a tour or service has commenced or in respect of any package, accommodation, meals, or any other services utilized.
Canceling a booking with HauteGastronomyTours can result in cancellation fees being applied by HauteGastronomyTours, as outlined below. Additional fees may be levied by the individual supplier or tour operator (see your HauteGastronomyTours Voucher for specific details). When canceling any booking, you will be notified via email or telephone of the total cancellation fees.
1. Event, Attraction, Theater, Show, or Coupon Ticket
- These are non-refundable in all circumstances.
2. Gift Certificate
- These are non-refundable in all circumstances.
3. Other Tour Products & Services
- If you cancel at least 7 days in advance of the scheduled departure, there is no cancellation fee.
- If you cancel between 3 and 6 days in advance of the scheduled departure, there is a 50 percent cancellation fee.
- If you cancel within 2 days of the scheduled departure, there is a 100 percent cancellation fee.
The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange, or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on HauteGastronomyTours, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees.
**Payment Processing**
Under this agreement, the payment processing services for services purchased on this website are provided by HauteGastronomyTours, depending on the type of payment method used for the purchase of services.

We will always make ourselves available to communicate with guests and help them resolve issues in a fair manner. We will investigate each issue, advocate for the guests and encourage our partners to resolve these things in a fair manner. If a partner fails to resolve an issue in a manner we think is fair, we will make that known, encourage change, and consider other options within the limited network if problems are not resolved well or are repeated regularly.
**Recreational Activity Release of Liability, Waiver of Claims, Express Assumption of Risk and Indemnity Agreement**
We strongly recommend that you purchase a comprehensive travel insurance policy prior to departure to protect your Product purchase. If
you cancel your trip or significantly alter travel dates, your travel insurance policy may reimburse the cost of cancellation fees and related expenses. Please review your travel insurance policy carefully for related terms and conditions.

**Express Assumption of Risk Associated with Recreational Activities**

I, hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with the recreational activity generally described as an outdoor adventure tour, including the rental of equipment and transportation associated therewith of which I am about to engage in. Inherent hazards and risks include but are not limited to:
1. Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.
2. Possible equipment failure and/or malfunction of my own or other’s equipment.
3. This activity takes place outdoors and therefore includes risks associated with exposure to elements, excessive heat, hypothermia, impact of the body upon the water, injection of water into my body orifices, encountering objects either natural or man-made, exposure to animals with the attendant risks of kicking, biting, shying away, running off, or otherwise moving in an unanticipated manner causing injury and/or death.
4. My own negligence and/or the negligence of others, including but not limited to operator error and guide decision making including misjudging terrain, rapids, weather, trails, and route location.
5. Attack by or encounter with insects, reptiles, and/or animals.
6. Accidents or illness occurring in remote places where there are no available medical facilities.
7. Fatigue, chill, and/or dizziness, which may diminish my/our reaction time and increase the risk of accident.

**Release of Liability, Waiver of Claims, and Indemnity Agreement**
In consideration for being permitted to participate in the activity(ies) described above the related activities, I hereby agree, acknowledge, and appreciate that:
1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named persons or entities, herein referred to as releases.
2. To release the releases, their officers, directors, employees, representatives, agents, and volunteers, and vessels from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releases or otherwise. By executing this document, I agree to hold the releases harmless and indemnify there in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.
3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releases, other than what is set forth in this Agreement. This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced.
